1. Who we are
This website, lumiselle.shop, is operated by VASS TEXTILES LIMITED, a private limited company registered in England and Wales under company number 04011112, with its registered office at Textile House, 11b Clarke Road, Bletchley, Milton Keynes, MK1 1LG, United Kingdom (“LUMISELLE”, “we”, “us”). 2. Scope
These terms apply to all orders placed through this website. We sell to consumers for their personal use. By placing an order you confirm that you are at least 18 years old and that the delivery address is in a country to which we deliver. Nothing in these terms affects your statutory rights as a consumer, including any mandatory consumer protection of the country in which you live.
3. Our products
Each product page describes the item’s design, fibre composition, care, fit and available sizes and colours. Product images show the design, colour and construction of each piece as offered for sale; colours can appear slightly different depending on your screen. Measurements in our size guide are body measurements and may vary by about 1–2 cm between garments. Our clothes are everyday garden wear: unless a product page states otherwise, they are not tested or intended as protective, waterproof or safety clothing.
4. Prices and currencies
Prices are shown in the currency you choose (US dollar, euro, pound sterling, Danish krone, Swedish krona, Norwegian krone or Swiss franc). The currency code is shown next to every price, and your order is charged in that currency. Shipping costs are added at checkout and shown before you pay. Deliveries outside the United Kingdom may be subject to import charges, as explained in our shipping policy. If your card is issued in another currency, your card issuer may apply its own exchange rate or fees.
If we discover an obvious error in the price of an item you have ordered, we will contact you and you may either confirm the order at the correct price or cancel it for a full refund.
5. How the contract is made
Product pages on this website are an invitation to order, not a binding offer. To order, you choose a colour and size, add items to your bag, go to checkout, enter your details, select a delivery and payment method, review your order and accept these terms. You can correct your entries at any time before placing the order. By clicking “Place order and pay” you make a binding offer to buy the items in your bag.
The contract is concluded when we send you an order confirmation by email after your payment has been authorised. We store the contract text; the order details and these terms are included in or linked from your confirmation email. Contracts can be concluded in English, German, Danish or French.
6. Payment
You can pay with the methods shown at checkout. Payment is taken when you place your order. Card payments are processed by our payment service provider; we do not see or store your full card details. See Payment and security for details.
7. Delivery
We deliver to the countries listed in our shipping policy, which also sets out processing times, delivery estimates and costs. Risk in the goods passes to you when they are delivered to you or to a person you have named.
8. Right of withdrawal, returns and cancellation
Consumers have a statutory right to withdraw from the contract within 14 days of receiving the goods. In addition, we accept returns of unworn items within 30 days of delivery. The conditions, the model withdrawal form and our cancellation rules are set out in our returns policy. You can withdraw online at any time during the withdrawal period using “Withdraw from contract here”.
9. Faulty goods
The statutory rights for goods that are not in conformity with the contract apply. In the United Kingdom these are set out in the Consumer Rights Act 2015; in the European Union a legal guarantee of conformity of at least two years applies. Please contact us if an item is faulty so that we can help quickly.
10. Promotions and discount codes
If we offer a promotion or discount code, its conditions (amount, eligible products, validity period and any minimum order value) are stated where the promotion is shown. Unless stated otherwise, only one code can be used per order, codes cannot be exchanged for cash, and they cannot be applied to orders already placed. If you return items bought with a discount, we refund the amount you actually paid.
11. Customer accounts
You can check out as a guest or create an account. Please keep your password confidential. You can ask us to close your account at any time.
12. Liability
We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory consumer rights. We are not liable for business losses, as we supply our products for private use only.
13. Intellectual property
All content on this website, including text, images, product designs, graphics and the LUMISELLE name and logo, belongs to us or our licensors. You may not copy or use it for commercial purposes without our written permission.
14. Complaints and dispute resolution
If you have a complaint, please contact us first at support@lumiselle.shop; we aim to resolve every complaint quickly and fairly. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board.
15. Governing law and courts
These terms are governed by the law of England and Wales. If you are a consumer living in another country, you also benefit from any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your country of residence.
16. Changes to these terms
We may update these terms from time to time. The version in force when you place your order applies to that order.
